General provisions
- This complaint procedure is issued in accordance with Act no. 40/1964 Coll. The Civil Code as amended (hereinafter referred to as the “Civil Code”), Act no. 250/2007 Coll. on Consumer Protection as amended / hereinafter referred to as the “Consumer Protection Act” /, Act No. 102/2014 Coll. on consumer protection in the sale of goods or provision of services on the basis of a contract concluded at a distance or a contract concluded outside the premises of the seller, as amended, and Act no. 22/2004 Coll. on electronic commerce as amended.
- The seller is Thexworld sro, with its registered office at Stromová 889/10, 900 42 Dunajská Lužná, ID number: 52 443 292, registered in the Commercial Register of the District Court Bratislava I, section: Sro, file number: 137826 / B, email: info @ cxw .sk (hereinafter referred to as the “seller”).
- The Complaints Procedure regulates the rights and obligations of the buyer – consumer in exercising the rights from defects in the thing (goods) in accordance with the concluded purchase contract at a distance with the seller through the electronic shop of the seller www.cxw.sk.
- Buyer is any person (natural or legal) who has concluded a contract for work (hereinafter also referred to as “contract”) with the seller in accordance with the General Terms and Conditions. Legal relations resulting from the exercise of rights from liability for defects between the seller and the buyer, which is a legal entity or a natural person entrepreneur are governed by Act no. 513/1991 Coll. Commercial Code as amended.
- A Consumer is any Buyer who, when concluding a purchase contract in accordance with these Complaints Rules and in accordance with the General Terms and Conditions published on the Seller’s website, does not act within the scope of his business activities.
- Products are goods that are intended for sale and are also published in the seller’s online store. Products are also other goods that the seller makes based on the buyer’s order, according to the requirements and specifications of the buyer.

Seller’s liability for defects in products (goods and services)
- The seller is obliged to deliver the product in accordance with the concluded contract, i. in the required quality, quantity and without defects (factual, legal).
- The seller is responsible for the defects of the sold product when taken over by the buyer. The seller is also responsible for defects that occur after receiving the product during the warranty period (warranty). The buyer must claim the defects from the seller without undue delay.
- The buyer is entitled to inspect the sold product before taking over.
- The seller is not responsible for defects caused by:
a) use of the product contrary to the instructions for use or the nature of the product,
b) unprofessional or unauthorized interference with the product,
c) foreign substances and liquids entering the product,
d) an unavoidable event (natural disasters, etc.),
Warranty
- The warranty period is 24 months. The warranty period for the used item is 12 months. Warranty periods begin to run from the receipt of the product by the buyer.
- If the buyer is not a consumer, the procedure is in accordance with the provisions of the Commercial Code and the warranty period is 1 year. The warranty period begins to run in accordance with the provisions of Art. IV, point 1 of these Complaints Procedure.
- The period from the exercise of the right of liability for defects until the time when the buyer was obliged to take over the product after the repair is completed does not count towards the warranty period. The seller is obliged to issue a confirmation to the buyer about when he exercised the right, as well as about the repair and its duration. As this is a custom production of products realized on the basis of individual customer requirements, this time is individually adjusted according to the instructions attached to each order.
- If the product is replaced with a new item, the warranty period starts again from the receipt of the new item.
- The product liability rights for which the warranty period applies shall lapse if they are not exercised during the warranty period.
- This complaint procedure is valid and effective at the time of its publication in the online store of the seller on 05.08.2020
- The Seller reserves the right to change these Complaints Rules. The obligation to notify the change of the Complaints Procedure in writing is fulfilled by placing it in the Seller’s Internet shop.
- The complaint procedure is a part of the General Terms and Conditions of the Seller.
